Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you and Beym, a company incorporated in Hong Kong ("Company", "we", "us", or "our"), governing your access to and use of the Beym mobile application and platform (the "Service").

By creating an account or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms.

1. Eligibility

1.1 Age Requirement

You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you are 18 or older. If we discover a user is under 18, we will immediately suspend and permanently delete their account without notice and without refund of any Virtual Currency.

1.2 Legal Capacity

You represent that you have full legal capacity to enter into a binding contract under the laws of your jurisdiction.

1.3 Geographic Restrictions

The Service is available globally except where prohibited by applicable law. You are responsible for determining whether your use is legal in your jurisdiction.

1.4 Account Reinstatement

You may not create a new account if a prior account has been permanently banned.

2. Account Registration and Security

2.1 Account Creation

To access core features, you must register by providing a valid phone number and completing verification via one-time passcode. You agree to provide accurate, current information.

2.2 Account Security

You are solely responsible for maintaining the confidentiality of your credentials. Notify us immediately at legal@beymlive.com if you suspect unauthorized access.

2.3 One Account Per Person

You may register and maintain only one active account. Creating multiple accounts to circumvent restrictions is prohibited.

3. Description of the Service

Beym is a social discovery platform enabling real-time random and direct video and voice calls, text messaging, virtual gifts, and community features including gamification and leaderboards. The Service uses automated and human-reviewed content moderation.

4. User Content

4.1 Your Content

"User Content" means any content you submit through the Service, including profile information, photographs, messages, voice notes, and video streams.

4.2 License Grant

By submitting User Content, you grant the Company a worldwide, non-exclusive, royalty-free, sublicensable license to use, reproduce, distribute, and display your User Content solely for operating and improving the Service. This license terminates when you delete your content or account.

4.3 No Expectation of Privacy in Video Calls

Random video calls connect you with strangers. You acknowledge that other users may record or capture content using third-party tools. You should have no expectation of privacy regarding content you display during video calls.

4.4 Content Moderation

By using the Service, you consent to your video streams being periodically analyzed by automated systems to detect policy violations. We reserve the right to remove any User Content that violates these Terms.

5. Prohibited Conduct

5.1 Prohibited Content

You must not submit or transmit:

• Nudity, sexual content, or sexually explicit material
• Content depicting or soliciting child sexual abuse material (CSAM) — violations are reported to law enforcement without notice
• Content glorifying self-harm, suicide, or eating disorders
• Graphic violence or gore designed to shock or disturb
• Hate speech that dehumanizes individuals based on protected characteristics
• Threatening, harassing, or intimidating content
• Content promoting terrorism, extremism, or mass violence

5.2 Prohibited Behavior

• Impersonating any person or entity
• Soliciting personal information from other users, particularly minors
• Engaging in sexual solicitation or offering sexual services
• Attempting to move conversations off-platform for commercial, sexual, or fraudulent purposes
• Harassing, stalking, threatening, or abusing other users
• Spamming other users with unsolicited messages
• Using the Service for commercial purposes without express written consent

5.3 Prohibited Technical Conduct

• Probing or testing the security or vulnerability of the Service
• Reverse engineering or attempting to derive the source code of the Service
• Using automated scripts, bots, or scrapers to interact with the Service
• Interfering with or disrupting the Service or related systems
• Using VPNs or proxies to bypass regional restrictions

6. Virtual Currency and In-App Purchases

6.1 Virtual Currency

The Service includes a virtual currency system ("Coins"). Coins are a limited license granted by the Company to access certain features. Coins have no monetary value, cannot be exchanged for real money, and cannot be transferred between accounts.

6.2 Purchasing Coins

Coins may be purchased through the Apple App Store or Google Play Store. All purchases are processed by Apple or Google. The Company does not directly process payment information.

6.3 No Refunds

All Coin purchases are final and non-refundable. Consumed Virtual Currency cannot be refunded. You agree the Company has no obligation to provide refunds for any reason.

6.4 Subscriptions

Subscriptions are billed on a recurring basis. You may cancel at any time through App Store or Google Play settings. No refunds for unused portions of a subscription period.

6.5 Forfeiture

Coins and other Virtual Currency will be forfeited upon account termination, voluntary or involuntary, without compensation.

7. Intellectual Property

The Service and all content provided by the Company are owned by the Company or its licensors and are protected by intellectual property laws. You are granted a limited, non-exclusive, revocable license to access and use the Service for personal, non-commercial purposes only. "Beym" and related marks are trademarks of the Company.

8. Privacy

Our collection, use, and sharing of your personal information is described in our Privacy Policy, which is incorporated into these Terms by reference.

9. Third-Party Services

The Service integrates with third-party services for video infrastructure, payment processing, content moderation, and push notifications. These operate under their own terms and privacy policies. The Company is not responsible for their conduct or privacy practices.

10. Disclaimers

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, THE COMPANY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THE SERVICE WILL BE AVAILABLE AT ALL TIMES, UNINTERRUPTED, OR ERROR-FREE.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW: (A) THE COMPANY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES; (B) THE COMPANY'S TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF THE TOTAL FEES YOU PAID IN THE SIX MONTHS PRECEDING THE CLAIM OR USD $100.

12. Indemnification

You agree to defend, indemnify, and hold harmless the Company and its officers, employees, agents, and licensors from any claims arising from: your use of the Service; your violation of these Terms; your violation of any third-party rights; or any User Content you submit.

13. Termination

13.1 Termination by You

You may delete your account at any time through Settings in the app. Deletion does not entitle you to a refund of any unused Coins or subscription fees.

13.2 Termination by Us

We reserve the right to suspend or permanently terminate your account at any time, with or without notice, for any reason including violation of these Terms or conduct we determine to be harmful.

13.3 Effect of Termination

Upon termination, your license to use the Service immediately ceases and all Coins are forfeited.

14. Dispute Resolution

14.1 Informal Resolution

Before initiating formal dispute proceedings, you agree to contact us at legal@beymlive.com and attempt in good faith to resolve the dispute informally for at least 30 days.

14.2 Binding Arbitration

If informal resolution fails, any dispute shall be finally settled by binding arbitration administered by the Hong Kong International Arbitration Centre (HKIAC) in accordance with the HKIAC Administered Arbitration Rules. The seat of arbitration shall be Hong Kong. The language shall be English.

14.3 Class Action Waiver

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU AGREE THAT ANY CLAIM MUST BE BROUGHT IN YOUR INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS OR REPRESENTATIVE PROCEEDING.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region of the People's Republic of China, without regard to its conflict of law principles.

16. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will notify you through the app. Your continued use after the effective date constitutes acceptance.

17. General Provisions

These Terms, together with the Privacy Policy and Community Guidelines, constitute the entire agreement between you and the Company. If any provision is found invalid, the remaining provisions continue in full force. You may not assign these Terms without our prior written consent.
